Election Commission

  • Election in India is an indirect expression of public opinion. The right to vote and to be elected in India is a statutory / legal right and not a constitutional or Fundamental Right, as it is not mentioned in the Constitution.
  • Every citizen of the country who is 18 years of age and who is not otherwise disqualified under any law on the basis of non-residence, malpractices, crime or corrupt conduct, can register in the electoral rolls as a voter in any such election. (Art 326).
  • Part-15 Article-324-329A of the Indian Constitution contains provisions related to the Election Commission.
  • Article 327 empowers Parliament to enact all the provisions relating to the election of Parliament and State Legislatures.
  • State Legislatures also have the power to make laws regarding elections under Article 328, the State Legislature may make laws (law) on such matters relating to the election of any of its House or Houses on which Parliament does not make provisions
